Q. What is meant by ‘Registered Title’?
A. Whenever ‘title’ or ownership to land or property is disposed of the transaction will need to be recorded at one of the 24 District Land Registries which cover England and Wales. The register kept at the Land Registry is divided into three parts;
- The Property Register, which describes the property
- The Proprietorship Register, which records who owns the
- property and (since April 2001) the price they paid
- The Charges Register, which gives details of charges against the property, eg mortgages or rights
In addition to this the Land Registry produces a Title Plan showing both the location and extent of the property. This Registration at one of the District Land Registries is paramount as it Guarantees the title of the new registered owner. The Registration will be submitted to the Land Registry office by the lawyer acting for the purchaser and should be carried out within 3 months of completion.
